The Demise of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the tension caused by the introduction of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been contained. A American diplomat spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Rhythm of Peace Talks and Military Action

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, diplomatic battles are conducted: optimistic declarations are delivered from multiple capitals. Immense energy is expended on managing particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "peace".

Nighttime Reality

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is capable of detecting projectile deployments from across the border, a ability afforded by timely intelligence. From observation points, defense planes that had been deployed to intercept incoming cruise missiles roared overhead – modern combat jets delivered to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: defensive missiles fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, most likely supplied through partner states. Every firing creates sudden vibrations, causing tremors. The instant of fear quickly transforms into sober acceptance: possibly the incoming missile won't hit its mark this time, preventing destruction from devastation and additional electricity failures.

Persistent Threats

Soon after, a heavy machine gun engaged a unmanned aircraft in the vicinity, part of a defensive team – probably Western-made equipment. Sadly, the shots failed to hit the enemy aircraft – it pressed on overhead toward its target.

Periodically, this continued until dawn. Kyiv faced the daybreak reports: multiple fatalities, damage and utility failures in multiple buildings as a result of the nocturnal offensive. As typically, everyone still went about their day – experiencing conflict. But those 24 hours demonstrated Ukraine's critical military reliance on international aid – a reliance that European nations are evidently unprepared to substitute in the immediate future.

Ineffective Peace Efforts

The detailed framework from American leadership generated strong feelings, controversy and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new approach from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They stabilise the situation but never actually achieve victory. This pattern will, certainly, endure.

Tactical Assessments

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. American leadership works based on a premise understood by seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The American government assumes that it is unfeasible to force Russia to surrender the land that it currently occupies in Ukraine's south or east.

The problem is that while acknowledging this situation, American administration does minimal to discourage Russia, through statements or actions, from believing that the current condition will not evolve additionally in its advantage in the near future.

Opposing Positions

Therefore, Moscow is convinced that time is on his side – that Ukraine and its allies are nearing depletion. Their motivation to accept conditions that does not give them the greatest potential benefit is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's leader remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing lives and land but preventing a complete military breakdown until circumstances change in its benefit.

Existing Situation

Objectively, there are no genuine requirements for a truce. Now, subjective factors are coming into play: personal goals to mediate resolution and achieve global acclaim, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unsuitable, so that their focus does not switch to domestic problems. And although their task will now be much harder after current events, it remains highly unlikely that this will alter their fundamental strategy.

These opposing factors are driving the talks.

Assessment and Future

It took a mere seven days to kill the 28 points of the latest plan. Forceful and unpredictable management of the matter by American leadership, opposition by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and demonstrate certain reluctance to change the course of events, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, largely rely on continued Western support.
